Introduction

Welcome to Electapros ("Platform", "we", "our", "us"), a next-generation hybrid digital marketplace designed to seamlessly integrate product commerce with on-demand service delivery across India. Electapros connects three primary categories of users: customers, sellers, and service providers. By accessing, registering, or using Electapros, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms & Conditions. If you do not agree with any part of these Terms, you must immediately discontinue the use of the Platform.

Section 02

Platform Nature & Role

Electapros operates as a technology-driven intermediary platform facilitating interactions between customers, independent sellers, and service providers. The platform enables: the sale and purchase of products between sellers and customers, and the booking and delivery of services between service providers and customers. Electapros does not own, manufacture, stock, or control any of the products listed, nor does it directly employ service providers. The platform's role is limited to enabling connections and facilitating transactions.

Section 03

User Eligibility

To access Electapros, all users must: • Be at least 18 years of age at the time of registration • Provide accurate, complete, and up-to-date personal information • Comply with all applicable laws and regulations in India • Not engage in fraudulent, illegal, or platform-disruptive activities The platform reserves the right to verify user information and suspend or terminate accounts that violate these eligibility requirements.

User Account & Security

Users are solely responsible for maintaining the confidentiality and security of their account credentials. Any activity carried out through a user's account shall be deemed to have been performed by the account holder. Security best practices: • Use strong, unique passwords and update them regularly • Avoid accessing accounts from unsecured or public devices • Be cautious of phishing attempts and unauthorized communications • Report any unauthorized access immediately through official support channels Electapros will never ask users to share passwords or OTPs through unofficial channels.

Services Offered

5.1 Product Marketplace

Independent sellers can list and sell products directly to customers. The platform provides infrastructure for order management, tracking, and communication. Electapros facilitates the entire order lifecycle including placement, payment processing, confirmation, and tracking.

5.2 Service Marketplace

Customers can book various services including electric appliance repair, installation, maintenance, and inspection. The platform uses automated location-based algorithms to assign requests to suitable service providers. Payments are processed centrally, ensuring accountability and transparency.

Seller Responsibilities: • Accurate and complete product descriptions • Transparent and lawful pricing • Proper inventory and availability management • Clear warranty terms where applicable • Issuance of valid GST-compliant invoices Platform Disclaimer: Electapros does not guarantee product quality, authenticity, or fitness for a specific purpose. All product-related responsibilities lie solely with the respective sellers.

Service Terms

All service providers operate as independent contractors, not as employees of Electapros. They are solely responsible for professional conduct, work quality, and compliance with applicable laws. Service providers bear full responsibility for quality, safety, and completion of services undertaken. The platform does not supervise service execution but monitors performance through ratings and reviews.

Section 08

Pricing & Payments

All prices are listed in Indian Rupees (INR). Payment methods include UPI, debit/credit cards, net banking, and digital wallets. Payment Flow: Customer → Platform → Seller / Service Provider Platform deductions may include: • Commission: Percentage-based fee for facilitating transactions • Service Fees: Charges for operational support and platform usage • Taxes: Applicable GST on platform commission and service fees

Section 09

GST & Taxation

Sellers are solely responsible for GST compliance, including registration (if required), filing returns, and issuing valid GST-compliant invoices with GSTIN, invoice number, date, and tax breakdown. The platform charges applicable GST on its commission and service fees as per prevailing Indian tax laws and provides appropriate invoices/statements for all deductions.

The order process follows a structured flow:

Section 11

User Obligations

Users agree not to: • Engage in illegal, fraudulent, or harmful activities • Post false, misleading, or fake reviews and listings • Attempt payment manipulation or unauthorized transactions • Misuse promotional offers and discounts • Copy, reproduce, or misuse platform intellectual property Violations may result in account suspension, termination, or legal proceedings.

Seller Obligations

Sellers must: • List only genuine, authentic, and legally compliant products • Maintain accurate inventory and process orders timely • Issue valid GST invoices where applicable • Honor return and refund requests per platform policy • Avoid listing counterfeit, defective, or prohibited items Non-compliance may result in account suspension, penalties, or permanent removal.

Service Provider Obligations

Service providers must: • Perform duties with due care, skill, and diligence • Maintain punctuality and adhere to scheduled time slots • Maintain professional and respectful behavior at all times • Follow safety standards and best practices • Communicate delays to customers through appropriate channels Repeated complaints, poor ratings, or policy violations may result in suspension or removal.

Ratings & Reviews

The platform's rating and review system promotes transparency and accountability. Customers are encouraged to share genuine feedback on products and services. Electapros reserves the right to monitor, moderate, or remove reviews found to be false, misleading, abusive, or in violation of platform guidelines. Misuse of the review system may result in content removal or account restrictions.

Intellectual Property

All intellectual property rights — including name, logo, trademarks, website/app design, software, graphics, and content — are the exclusive property of Electapros or its licensors, protected under applicable Indian IP laws. Users are granted a limited, non-exclusive, non-transferable right to access the platform for its intended purposes only. Unauthorized use, duplication, or misuse of platform IP may result in strict legal action.

Limitation of Liability

Electapros shall not be held liable for: • Direct, indirect, incidental, or consequential losses from platform use • Product defects, poor quality, or incorrect descriptions (Seller's responsibility) • Damages or unsatisfactory outcomes from services (Service Provider's responsibility) • Fraudulent activities or misrepresentation by third-party users The platform may assist in resolving disputes but does not guarantee outcomes. Such assistance does not constitute acceptance of liability.

Indemnity

Users agree to indemnify, defend, and hold harmless Electapros, its owners, affiliates, employees, and representatives from and against any claims, demands, liabilities, losses, damages, costs, or expenses arising out of: • Misuse of the platform or fraudulent activities • Unauthorized transactions or violation of these Terms • Failure to comply with applicable Indian laws and regulations This indemnity obligation survives the termination or suspension of the user's account.

Dispute Resolution

• The platform acts as a neutral mediator between all parties • Disputes must be raised through the official support system with relevant proofs • Standard resolution time: 24–72 hours from formal registration • The platform may contact involved parties and review transaction records • Platform decisions during mediation are based on evidence and fairness but are not legally binding • Unresolved disputes may be escalated to appropriate legal authorities • Legal proceedings are subject to the jurisdiction defined in these Terms

Termination

The platform may suspend, restrict, or permanently terminate accounts for: • Fraudulent activities, fake transactions, or payment manipulation • Violation of platform policies or repeated customer complaints • Non-compliance with Indian IT laws, GST rules, or other regulations Users may voluntarily deactivate their accounts at any time. Upon termination, users may lose access to account data, order history, and associated information. All obligations arising prior to termination remain enforceable.

Force Majeure

Electapros shall not be held liable for failure or delay in performance due to Force Majeure Events including: • Natural Disasters: Earthquakes, floods, cyclones, fires • Government Restrictions: Lockdowns, legal orders, policy changes • Network Failures: Internet outages, server downtime, cyber-attacks Possible impacts include delivery delays, service rescheduling, platform downtime, and payment processing delays. The platform will make reasonable efforts to resume normal operations as soon as possible.

Section 21

Modification of Terms

Electapros reserves the right to modify, update, amend, or revise these Terms at any time. Updates are effective immediately upon publication on the platform. Users are responsible for periodically reviewing the Terms. Continued use of the platform after updates constitutes acceptance of the revised Terms. If you do not agree with modified Terms, you must discontinue use of the platform immediately.

Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India, including laws related to information technology, consumer protection, taxation, and electronic transactions. Any disputes, claims, or legal proceedings arising from the use of Electapros shall be subject to the exclusive jurisdiction of the courts located in Uttar Pradesh, India.
